A note from Lou Fey:

The Summer of 2009 edition of the ABA Tort Trial Insurance Practice Insurance Coverage Litigation Committee Newsletter contained an article entitled 'The Use of Experts In Insurance Bad Faith Litigation' The article concluded that while the use of an expert witness is not required to prove bad faith, such expert testimony is quite often helpful to both the plaintiff and defense. Most importantly the article concludes that the most effective experts are those who are qualified by true experience in the insurance industry and who support their position with case facts. I have over thirty years experience in all facets of the Insurance Industry including complex Claims - multi-line, Underwriting, Insurance Company Management, and Agency Operations. I am licensed as an adjuster, producer / agent and I am also FEMA certified. I base my opinions on facts gleamed from the discovery documents and deposition testimony, using established facts. I base my opinions on the undisputed documented facts of the case to avoid any possible under cutting of my position. I have been Daubert tested and have been deemed qualified at both the State and Federal levels based on those standards. It will be hard to find a more experienced (hands on) insurance expert.
